    CITIZENS’ CHARTER

    Introduction

    The Department of Prosecution with its Headquarter at Panchkula controls the cadres of District Attorneys/Deputy District Attorneys/Assistant District Attorneys posted in each District Headquarter, Sub Division and in various departments.

    A list of Senior Officers of the Department alongwith their designation addresses and Telephone number is enclosed at Annexure ‘A’.

    Service provided by the Department

    The Department of Prosecution provides following services:-

    1. To Defend the State cases (Civil & Criminal) upto the Court of District and Sessions Judge.
    2. To control the Civil and Criminal litigation of the State in the Supreme Court of India.
    3. To tender legal advice to the various department of the State in criminal matters.
    4. To make the payment to the Advocates engaged by various departments pertaining to their cases lunched outside the State upto the court of District and Sessions Judge.
    5. To file SLPs/ Writ Petitions in the Supreme Court of India on behalf of the State.

    One Public Prosecutor/Assistant Public Prosecutor is appointed in each court functioning at Sub-Division or at District Headquarter to defend the civil and criminal cases on behalf of the State.

    • Criminal Litigation

                                 After the pronouncement of the judgment in criminal cases, the concerned Public Prosecutors/Public Prosecutor incharge of the District, Scrutinize the judgment and if in a particular case it is found that the case is fit for filing appeal, the concerned Public Prosecutor with the consent of the Public Prosecutor incharge of the District recommends to the Superintendent of Police for filing further appeal in the appropriate Court. If in a particular case it is suggested that the case is not fit for filing appeal the same is sent by the concerned Public Prosecutor through the Public Prosecutor Incharge to the Superintendent of Police who intern sent the same of the Director of Prosecution for further examination. The Superintendent of Police sent the opinion to the District Magistrate, who is incharge of District.

    • Civil Litigation

    The Civil Litigation at the District level is controlled by the Prosecution Agency functioning at the District level and at the State Level the civil work is controlled by the Legal Remembrancer who used to issue instructions to the Govt. Pleaders posted at District Headquarter and at Sub-Division level to defend a particular case on behalf of the State. After the pronouncement of the judgment in a civil case the concerned Govt. Pleader in consultation with the Govt. Pleader incharge of the District recommend for filing appeal to the Legal Remembrancer Haryana and in a case it is not found fit for filling further appeal the same is also sent to the Legal Remembrancer, Haryana by the concerned Govt. Pleader in consultation with the Govt. Pleader incharge of the District to the Legal Remembrancer Haryana for further examination who in turn sent the same to the Advocate General, Haryana for filing appeal in the next Higher Court or to the concerned department, if not found fit for filing appeal.
